Employer who fails to follow the minimum standard of housing, accommodation and facilities for workers 1990, act 446 under section 24D can be fined up to maximum RM50,000. The worst part is it will affect your hiring of foreign workers when you apply approval from JTKSM and KDN. Therefore, we will help you the best way to setup your hostel.
Here are the tips.
1. Look for the building which originally constructed for housing and accommodation. For instance, apartment & landed housing are the best options for you. However, it’s not easy to get few units to keep number of workers stay at the same place. Then, many owners are not willing to make their property as workers’ hostel but this is the best cost saving way to setup your hostel. Try not to get shop house, shop office, SOHO or cabin to setup hostel because you need to get approval from local authority branch to convert the utility of the building before you apply approval from JTKSM.
2. If you must renovate your hostel or convert the utility of the building, you must appoint a contractor who know the way to get approval from local authority branch. To get the approval, contractor must work together with architect to submit new floor plan before the renovation work start. You must inform architect about the room size and number of toilets under the requirements of act 446, section 24D. Then, architect will work out a floor plan which fit your needs and comply local authority branch requirements.
3. Once your hostel is renovated, you need to prepare the facilities according to the requirements of act 446, section 24D. For basic requirements, mattress with pillow & blanket and locked cabinet are non-sharable facilities, while first aid kit, dustbin, fan & lamp, cooking stove, dining table, etc. are sharable facilities. However, TV, refrigerator and fire extinguisher are not compulsory facilities. However, we are strongly suggesting that fire extinguisher and refrigerator should be ready if your workers cook.
Once everything is ready, you can apply approval from JTKSM by online at ( http://akta446.mohr.gov.my/ ) and make payment based on the number of workers who stayed in the building. BASIC FACILITY REQUIREMENTS
SPACE:
For every single laborer you hire, he or she must get at least 9 square feet worth of sleep space in the bare minimum. With that being said, a 54 square feet hostel should house 6 laborers at the very max.
LIVING EQUIPMENT:
If a single bed measures not less than 1.7 square meters. And if a double-decker bed is provided, the space between two beds shall not be less than 0.7 meters.
A mattress at least four inches thick, a pillow and a blanket.
1 locker for each laborer that is at least 0.35m in length, 0.35 meters width, and 0.9 meters in height.
FACILITY:
The accommodation should provide the following facilities:
Rest Room
Dining area with tables and chairs
Kitchen
Washroom and/or toilet
Clothes drying area
Every space has to have a standard electricity supply outlet and fire prevention measures.
USAGE PROPORTIONS:
For every washroom and toilet that is made should be used by 6 tenants max.
A separate accommodation for male, and a separate one for females.
First Aid Kits that should be provided by the company and should be in proportion to the number of laborers staying in the said accommodation.
SAFETY PREVENTION MEASURES:
A fire prevention system must be ready in place. Respective and relevant departments should verify and approve the same fire prevention certificate.
First aid kit must be provided by employers for the laborers to use. It should be an easy kit for the laborers to use and is easy to process during any emergency.
SPECIFICATIONS FOR BED & PERSONAL CABINET
One will need to provide these to each employee, and employees cannot share them.
A bed that is sized no less than 1.7-meter square (single bed or double-decker bed)
Mattress in which its thickness no less than 4 inches
Pillow and blanket with covers
Personal cabinet with lock (0.35m Long x 0.35m Wide x 0.9m Height)
